1. Introduction
These Terms of Service ("Terms") govern the use of the online platform and related services ("Service") provided by EstateVids UG ("EstateVids", "we", "us"), a company incorporated under the laws of Germany. By accessing or using the Service, you ("User", "you") agree to be bound by these Terms. If you do not agree, you may not use the Service.
This document reflects obligations under EU consumer protection laws, German law, and GDPR.
2. Scope and Eligibility
The Service is available only to individuals 18 years or older.
If you use the Service on behalf of a company or organization, you confirm that you are authorized to bind that entity to these Terms.
3. Description of Service
EstateVids provides an online video generation platform for creating real estate and architecture videos from images. The Service is subscription-based and includes access to templates, video generation tools, storage, and export options.
4. Account Registration
To access the service, you must create an account.
You are responsible for keeping your login credentials secure.
You are liable for all activity that occurs under your account.
5. Subscription, Payments, and Refunds
5.1 Subscription Plans
We offer monthly and annual subscription plans with tiered features. All fees are payable in advance.
5.2 Payment Processor
Payments are processed by third-party providers (e.g., Stripe). You must keep your payment details accurate and up to date.
5.3 Taxes
Unless otherwise indicated, all prices are net prices. EstateVids may apply the Kleinunternehmerregelung (§19 UStG) in Germany, meaning VAT is not charged. Users outside Germany may be responsible for self-assessed VAT or import taxes.
5.4 Right of Withdrawal (EU Consumers)
As an EU consumer, you may withdraw from your subscription within 14 days of purchase without giving any reason.
This right expires if you:
Start using the Service within the withdrawal period, and
Explicitly consent to immediate use and acknowledge the loss of your withdrawal right.
To withdraw before activation, email us at support@estatevids.com with a clear request. A model form is available on request.
5.5 Refunds and Cancellations
Monthly Plans: Non-refundable after billing; cancellation applies at end of current billing cycle.
Annual Plans: Refund available within 14 days of purchase. After this, no refunds are granted.
Upgrades: Pro-rated and take effect immediately.
Downgrades: Effective at next billing cycle.
6. Ownership and Rights to Content
6.1 User Content
You retain ownership of input data, such as images, text, and property details. By submitting content, you grant EstateVids a limited license to process it for providing the Service.
6.2 Output Ownership
You own the generated video outputs, subject to applicable copyright laws. EstateVids makes no guarantee regarding ownership of AI-generated works under all jurisdictions.
6.3 Attribution
When publishing content generated with EstateVids, attribution (e.g., “Created with EstateVids”) is appreciated but not mandatory.
6.4 Publication and Marketing Use
Content generated under free or trial accounts may be used in EstateVids marketing materials with prior notice.
Content from paid accounts remains private unless you opt in for promotional use.
7. Acceptable Use
You agree not to:
Reverse-engineer, copy, or tamper with the Service.
Use the Service to infringe intellectual property or third-party rights.
Upload unlawful, harmful, or offensive content.
Build a competing product using EstateVids outputs.
Circumvent security, fair use, or subscription restrictions.
8. Third-Party Tools and Licenses
EstateVids integrates third-party AI models and cloud services. Your use of the Service may be subject to the licenses of those tools where applicable.
9. Privacy and Data Protection
We comply with the General Data Protection Regulation (GDPR) and German privacy laws.
Personal data is processed within the EU.
Technical and organizational measures are in place for data security.
We do not sell or share your personal data with third parties beyond service providers.

9.1 Data Processing Agreement (DPA)
For business customers, a GDPR-compliant DPA is available upon request.
10. Service Availability and Limitations
EstateVids aims for high uptime but cannot guarantee uninterrupted access.
Temporary service disruptions may occur due to maintenance or technical issues.
We may modify features, apply fair use limits, or suspend accounts that violate these Terms.
11. Export Compliance
You agree not to use the Service in violation of applicable EU, US, or UN trade restrictions or sanctions.
12. Disclaimer and Limitation of Liability
To the maximum extent permitted by law:
The Service is provided “as-is” without warranties.
We are not liable for indirect, incidental, or consequential damages.
Our total liability is limited to the amount you paid in the last 12 months, or €100, whichever is higher.
13. Indemnification
You agree to indemnify and hold harmless EstateVids from claims, damages, or liabilities arising from your use of the Service or your breach of these Terms.
14. Termination
We may suspend or terminate your account if you violate these Terms. Upon termination, all rights granted to you end immediately.

15. Jurisdiction and Governing Law
These Terms are governed by the laws of the Federal Republic of Germany.
For consumers: disputes may be brought before the courts of your country of residence in the EU.
For business customers: exclusive jurisdiction is Berlin, Germany.
16. Changes to the Terms
We may update these Terms. Material changes will be communicated at least 30 days in advance. Continued use of the Service after updates constitutes acceptanc
17. Severability
If any provision is found invalid, the remaining provisions remain enforceable.
